Mantra+ Terms and Conditions

INTRODUCTION

  1. By participating in the Mantra Plus Loyalty Program, applying for Membership, becoming a Member, using the Membership Number or accepting or redeeming any of the benefits, the Member:
    1. agrees that they have read and understood the Loyalty Program Terms and Conditions;
    2. agrees to be bound by these Loyalty Program Terms and Conditions; and
    3. consent to Direct Marketing and processing of your Personal Information in accordance with these Loyalty Program Terms and Conditions.
  2. These Loyalty Program Terms and Conditions are effective as at the Effective Date and may be amended from time to time. The current Loyalty Program Terms and Conditions are those available at "https://mantrahotels.com/plus/terms".
  3. Certain Benefits offered to Members may only be available where the Member has:
    1. Booked via a Mantra Plus Booking Service; and/or
    2. been issued a Membership Number no less than 24 hours prior to check-in.
  4. It is the Members responsibility to enter, provide and/or login using the Membership Number to obtain the Benefits.
  5. Capitalised words in these Loyalty Program Terms and Conditions have the meaning given to them in clause 18 (Definitions).

APPLICATION OF TERMS AND CONDITIONS

  1. These Loyalty Program Terms and Conditions apply to all Members and govern the Mantra Plus Loyalty Program.
  2. These Loyalty Program Terms and Conditions replace the Club See You Soon terms and conditions.
  3. Additional terms and conditions may apply to the redemption of Benefits (for example the Mantra Group's Booking Terms and Conditions https://www.mantrahotels.com/terms-and-conditions/ will apply to any accommodation booked by a Member or Internet Terms and Conditions will apply to use of internet supplied).
  4. A Member agrees that each time the Member redeems or claims a Benefit or uses the Membership Number they agree to the Loyalty Program Terms and Conditions current at that time.

CANCELATION OF MANTRA PLUS LOYALTY PROGRAM

  1. Mantra Group does not warrant or represent that the Mantra Plus Loyalty Program will have perpetual existence.
  2. Mantra Group may terminate or suspend part or the whole of the Mantra Plus Loyalty Program at any time.
  3. Thirty (30) days' notice will be provided to Members should Mantra Group decide to terminate the Mantra Plus Loyalty Program at any stage. Members will be notified via email and on our website https://mantrahotels.com/plus/.

MEMBERSHIP

  1. By applying to become a Member the individual agrees that they have read, understand and agree to these Loyalty Program Terms and Conditions.
  2. Membership in the Mantra Plus Loyalty Program is available to individuals who:
    1. are eighteen (18) years of age or older;
    2. provide valid and accurate Personal Information when applying;
    3. are not already a Member;
    4. are not otherwise precluded from becoming a Member in these Loyalty Program Terms and Conditions.
  3. Acceptance of a Member in the Mantra Plus Loyalty Program will occur upon Mantra Group issuing the Member with a Membership Number.
  4. Members may update their Personal information by contacting the Mantra Group Reservations Team contact details of which are located at https://www.mantrahotels.com/contact/.
  5. Memberships are not transferable.
  6. Only a Member is entitled to the Benefits associated with the Mantra Plus Loyalty Program, unless these Loyalty Program Terms and Conditions provide that the Benefits extend to other than the Member.
  7. The Benefits are offered on the condition that the Member provides evidence of their Membership and/or inserts their Membership ID Number at the time of making a booking or redeeming the Benefit.
  8. Members may cancel their Membership by contacting the Mantra Group Reservations Team.

BENEFITS AND REWARDS - GENERAL

  1. Certain Benefits are only available where the Member has Booked via a Mantra Plus Booking Service. These Loyalty Program Terms and Conditions set out which Benefits only apply where the Member has Booked via a Mantra Plus Booking Service.
  2. Members are offered certain Benefits which may be varied by Mantra Group from time to time, without prior notice.
  3. The Benefits available to Members from time to time can be viewed at https://www.mantrahotels.com/plus. Special offers may also be sent to Members by mail, email, text message or other digital means.
  4. Special offers may be sent by Mantra Group to Members in accordance with clause 15 (Direct Marketing).
  5. Further terms and conditions may apply to Benefits in addition to these Loyalty Program Terms and Conditions.

BENEFITS AND REWARDS - INTERNET ACCESS

  1. In addition to any other limitations set out in these Loyalty Program Terms and Conditions the Internet Access Benefit is only available to those Members that have Booked via a Mantra Plus Booking Service.
  2. If the relevant property in Schedule One of these Loyalty Program Terms and Conditions is shown as having wifi available, and where the internet access is not; provided as part of a packaged rate, resort fee, made complimentary as part of promotion or special offer, paid for prior to the Member’s stay or otherwise provided, Members will be entitled, during their stay, to complimentary in-room wifi Standard Internet Access.
  3. Standard Internet Access means access to the internet provided by an internet service provider contracted to Mantra Group at the relevant property with a maximum download of one gigabyte per Mantra Room, per day, with a maximum of three devices per Mantra Room.
  4. Internet access speeds and connectivity vary by property and the Member acknowledges that the internet access may not be uninterrupted or error-free.
  5. The Internet Terms and Conditions apply to access and use of the internet in addition to these Loyalty Program Terms and Conditions and the Member acknowledges and agrees that by connecting to the internet supplied to the Member pursuant to this Benefit it accepts the Internet Terms and Conditions and the Loyalty Program Terms and Conditions.
  6. Mantra Group may immediately suspend, terminate or limit your internet access should these Loyalty Program Terms and Conditions and/or the Internet Terms and Conditions be breached.

BENEFITS AND REWARDS - FOOD AND BEVERAGE

  1. Subject to any limitations set out in these Loyalty Program Terms and Conditions the Food and Beverage Benefit is available to all Members of the Mantra Plus Loyalty Program.
  2. Members are eligible to receive the Food & Beverage Discount on items of food and beverage with the purchase of at least one main meal, whilst dining at MG Restaurants, for that Member and no more than 9 other persons.
  3. The Food & Beverage Discount cannot be redeemed for breakfast, mini-bar, in-room dining, conferences and events services.
  4. The Food and Beverage Discount, may be suspended, at Mantra Group's discretion during Special Events Periods.
  5. The Food & Beverage Discount is not valid with any other offer, discount or special promotion.
  6. The Food & Beverage Discount is not subject to the Member staying in a Mantra Group Property at the time of redemption.

BENEFITS AND REWARDS – COMPLIMENTARY DRINK

  1. In addition to any other limitations set out in these Loyalty Program Terms and Conditions the Complimentary Drink Benefit is only available to those Members that have Booked via a Mantra Plus Booking Service and where the property is identified in Schedule One as offering the Complimentary Drink Benefit.
  2. Members are entitled to receive one Complimentary Drink per Stay, for each guest registered to the room booked by the Member.
  3. Guests that receive the Complimentary Drink by way of Voucher that are:
    1. over 18 years of age will be provided with a Drink Voucher for either an Alcoholic Beverage or Non Alcoholic Beverage; and
    2. under 18 years of age will be provided with a Drink Voucher for a Non Alcoholic Beverage only.
  4. Each Drink Voucher may be exchanged and surrendered at a MG Restaurant for one complimentary beverage and cannot be redeemed for beverages from the minibar, or in room dining.
  5. To redeem your Drink Voucher, if requested, you must provide proof of your Membership at time of redemption.
  6. The Drink Voucher cannot be transferred or exchanged for cash or credit.

BENEFITS AND REWARDS – MANTRA PLUS PRICE PROMISE

  1. In addition to any other limitations set out in these Loyalty Program Terms and Conditions the Mantra Plus Price Promise is only available to those Members that Book via a Mantra Plus Booking Service.
  2. Subject to the requirements of clauses 4 and 9.5 and limitations of clause 9.7, Mantra Group promises that should a Member at the time of making the Booking find a Lower Rate on an Eligible Medium for a Comparable Booking of a Mantra Room on a Mantra Plus Booking Service that meets the criteria in clause 9.5, Mantra Group will beat the Lower Rate by five percent (5%).
  3. Any claim against the Mantra Plus Price Promise, must be made at the time of making the Booking by contacting the Mantra Group Reservations Team the contact details of which are located at https://www.mantrahotels.com/contact-us/. The Mantra Plus Price Promise, cannot be redeemed or claimed after a Booking has been made or deferred to a later date. Mantra Group Reservations Team must be able to verify that the Lower Rate is valid, available and meets criteria in clause 5, at the time of making the Booking.
  4. The Mantra Plus Price Promise only applies to websites or offers that are accessible to the public at large without membership or subscription requirements.
  5. To be eligible for the Mantra Plus Price Promise the Lower Rate must meet all of the following criteria:
    1. be for a Mantra Room;
    2. be for the same room type;
    3. be for the same dates;
    4. be in the same building as the intended Stay;
    5. be for the same number of room guests;
    6. include all applicable taxes rates and charges;
    7. be in the same currency as advertised on the Mantra plus Booking Service;
    8. have the same inclusions if a packaged rate; and
    9. be available and visible to, and verifiable by, the Mantra Group Reservations Team at the time of Booking.
  6. Mantra Group acting reasonably, will make the final decision as to whether the criteria in clause 5 has been fully satisfied.
  7. The Mantra Plus Price Promise can only be redeemed by a Member in respect of the Mantra Room they will be occupying and no more than 9 other Mantra Rooms, for the same date(s).

BENEFITS AND REWARDS – LATE CHECKOUT

  1. This Benefit is only available to those Members that have booked via a Mantra Plus Booking Service.
  2. Upon request and where available a Member will be entitled to complimentary Late Check-Out.
  3. Late Check-Out cannot be guaranteed due to operational reasons and granting of Late Check-Out is at Mantra Groups absolute discretion and Members should enquire as to availability of Late Check-out upon check-in registration.

PERSONAL USE ONLY

  1. The purpose of the Mantra Plus Loyalty Program is to provide a benefit to approved Members. Membership to the Mantra Plus Loyalty Program cannot be purchased, transferred or used for commercial benefit. The room rates accessible to Members apply only to bookings for genuine personal use by you and the people staying with you. Bookings made through your Membership with Mantra Plus Loyalty Program cannot be on-sold or transferred to another person.
  2. If requested, photographic identification matching the name on the booking must be shown on check-in or at the time of redemption of a Benefit.
  3. If a booking or redemption of a Benefit is not made for genuine personal use, or if, upon request, photographic identification matching the name on the booking is not shown on check-in or the redemption of a Benefit, the booking may be cancelled and you may be liable to pay liquidated damages equal to the full booking amount plus any other costs incurred by Mantra Group in connection with the booking, as compensation for breach of these terms and conditions. Any pre-payment will be forfeited to Mantra Group as liquidated damages under this term.

THIRD PARTY PRODUCTS AND SERVICES

  1. Mantra Group sometimes includes third party products or services in special packages. Mantra Group is not liable under any circumstances for any failure by third party providers to provide products or services, nor for any error, alteration or change of any kind made by those third party providers following acceptance of a booking by them.
  2. All third party coupons, vouchers, receipts and tickets are issued subject to the terms and conditions specified by those third parties.
  3. Mantra Group does not warrant the accuracy of any information, statements or representations made by third parties. Mantra Group is not liable for any act, omission, default or negligence of any third party provider.

EXCLUSIONS OF LIABILITY

  1. To the extent it is lawfully able, the Member releases and holds harmless Mantra Group and its current and former officers, employees and agents for any loss, damage or Claim of any kind arising out of the Mantra Plus Loyalty Program, the Loyalty Program Terms and Conditions and the Benefits including but not limited to consequential or economic loss, occurrences or conditions beyond its control, terrorism, act of God, war, strikes, theft, delay, cancellation, civil disorder, disaster or Government regulations.

CHANGES TO MANTRA PLUS LOYALTY PROGRAM

  1. Mantra Group may make changes to the Mantra Plus Loyalty Program, Loyalty Program Terms and Conditions or the Benefits in its discretion.
  2. If Mantra Group deem the changes to be material, Mantra Group will provide notification of the changes at https://www.mantrahotels.com/plus/.
  3. Members should review the current Mantra Plus Loyalty Program Terms and Conditions available at https://www.mantrahotels.com/plus/ before redeeming or applying for a Benefit.

DIRECT MARKETING

  1. The Member acknowledges and agrees to Mantra Group providing marketing material to the Member via phone, post, email, text message or other digital means.
  2. Mantra Group will comply with its Privacy Policy when conducting activities in accordance with this clause 15 further details of which are located at clause 17 and at https://www.mantrahotels.com/privacy/.

JURISDICTION

  1. The Loyalty Program Terms and Conditions and Membership are governed by and will be construed in accordance with the laws of the State of Queensland, Australia irrespective of where the application for the Membership has been completed by the Member or submitted to Mantra Group and the Member submits to the non-exclusive jurisdiction of the State of Queensland.
  2. If part or all of any clause of these Loyalty Program Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, and where that is not possible, the offending clause (or part thereof), will be severed from these Loyalty Program Terms and Conditions and the remaining provisions of these Loyalty Program Terms and Conditions will continue to have full force and effect.

PRIVACY

  1. Mantra Group is dedicated to safeguarding personal privacy. It recognises that individuals have a right to control how their personal information is collected and used. Mantra Group will only collect and hold a Member's personal information about you that is reasonable necessary to undertake our business activities and functions, including delivering access to the internet.

DEFINITIONS

  1. In these Loyalty Program Terms and Conditions unless the context otherwise requires:
    • Alcoholic Beverage means house beer or house wine.
    • Benefit means a product, service, discount or arrangement offered, and made available, to a Member of the Mantra Plus Loyalty Program in accordance with these Loyalty Program Terms and Conditions.
    • Book or Booking means the reserving of a Mantra Room(s) via a Mantra Plus Booking Service.
    • Claim means any actions, legal claim, demand, suit, judgement or proceedings of any nature or kind whatsoever.
    • Comparable Booking means a booking for a Mantra Room that satisfies all of the criteria in clause 5.
    • Complimentary Drink means either:
      • a bottle of water; or where the property at which the Member is staying includes an MG Restaurant within close proximity;
      • a Drink Voucher that can be exchanged for an Alcoholic Beverage or a Non Alcoholic Beverage, as the case may be.
    • Complimentary Drink Benefit means the entitlement to a Complementary Drink provided in accordance with clause 8.
    • Direct Marketing has the meaning given to it in clause 15 (Direct Marketing).
    • Drink Voucher means a voucher issued by Mantra Group to the Member or the registered guests sharing the room with the Member that can be redeemed for a Complimentary Drink in accordance with clause 8.
    • Effective Date means 17 March 2017.
    • Eligible Medium means the medium set out in clause 4.
    • Food and Beverage Benefit means the entitlement to the Food and beverage Discount provided in accordance with clause 7.
    • Food and Beverage Discount means the amount of 10% off all items of food and beverage acquired at MG Restaurants.
    • Internet Access Benefit means the complementary internet access provided in accordance with clause 6.
    • Internet Terms and Conditions means the terms and conditions of the relevant internet service provider which are made available for review and must be accepted, prior to gaining the internet access.
    • Late Check-Out means a check-out time of 12.00pm.
    • Lower Rate means a rate provided by a service other than a Mantra Plus Booking Service that is less than the rate provided to the Member for a Comparable Booking via a Mantra Plus Booking Service.
    • Loyalty Program Terms and Conditions means these terms and conditions, as amended from time to time.
    • Mantra Group means SAMARAD Pty Ltd trading as Mantra Group.
    • Mantra Group Reservations Team means the reservations team for booking Mantra Group Rooms whose contact details can be found at https://www.mantrahotels.com/contact/.
    • Mantra Group’s Booking Terms and Conditions means the terms and conditions applicable to booking Mantra Rooms a copy of which is available at https://mantrahotels.com/plus/terms/
    • Mantra Plus Booking Service means:
      • any of the mediums listed in Schedule 3;
      • via contacting the Mantra Group Reservations Team; or
      • via the phone, facsimile, or in person at any of the Participating Properties receptions.
    • Mantra Plus Loyalty Program means the loyalty program and known as the Mantra Plus Loyalty Program” or “Mantra+”, as amended from time to time, or any replacement program.
    • Mantra Plus Price Promise has the meaning in clause 2.
    • Mantra Room means a room that is managed by Mantra Group or its associated entities.
    • Member means an individual that has been granted Membership that has not been terminated cancelled or revoked.
    • Membership means the membership of the Mantra Plus Loyalty Program.
    • MG Restaurant means each restaurant set out in Schedule Two.
    • Non Alcoholic Beverage means a bottle of water or soft drink.
    • Participating Properties means the Mantra Group properties listed in Schedule One of these Loyalty Program Terms and Conditions which can also be found at http://www.matrahotels.com/plus/participating-properties/.
    • Personal Information has the meaning given to it in the Privacy Act 1988 (Cth).
    • SAMARAD Pty Ltd means Samarad Pty Ltd ACN 100 072 704.
    • Special Events Periods means published public holidays in the location of the relevant Mantra Group Property or MG Restaurant including but not limited to New Year Eve, New Year, Easter, Christmas and any other periods nominated by Mantra Group as being a Special Events Period details of which are located at https://www.mantrahotels.com/terms-and-conditions/special-dates/.
    • Standard Internet Access has the meaning in clause 3.
    • Stay means the continuous period of occupying a Mantra Room made under a Booking.
